[corresponds to page 1 of contract between the trustees of the Charity School of Kendal and perspective instructors]
This Indenture made this twenty [carrot mark] seventh [above carrot mark] day of November A D 1828
between Arvine Wales Isaac Bowman and William Hurly
surviving Trustees of the "Charity School of Kendal" in their
corporate capacity and on behalf of the said Charity
school of the first part and Hezekeah Camp William G
Macy, Edward Dunn and James Bayless of the second
part. Whereas Charity Rotch late of Kendal Stark
County deceased having left by will a large amount of
property for the establishment of a Charity School
the bringing up and educating of poor children; and
having by her said will particularly directed the [illegible]
of the application of such property: And whereas the [illegible]
lature of Ohio for the purpose of aiding the benevolent
designs of the said donor, having by an act of the
said Legislature passed January twenty forth AD
made and created the above named Arvine Wales,Isaac
Bowman and William Her[illegible] together with James W. Sat[illegible]
and politic with perpetual succession by the name of
the "Charity School of Kendall" and also with power to
contract and be contacted with in their corporate
capacity. Now therefore this indenture [illegible] forth
that the said parties of the first part in their corporate
capacity and on the behalf of the said Charity School
for and in consideration of the covenants and agreements
hereinafter contained on the part and behalf of the said party
of the second part their heirs executors and administrators
to be performed fulfilled and kept, have engaged and
appointed and by these present do engage and appoint
the said parties of the second part managers and
instructors for the said Charity School, for the Term of
eight years for and after the first day of January next
[illegible] the date hereof fully to be complete and ended.
And the said parties of the first part in their corporate
capacity for themselves and their successors in office do
covenant and agree to and with the said parties of the
second part their heirs, executors and administrators that
they the said parties of the first- part and their success-
-ors in office shall and will yearly and every year of
the said Term pay to the said parties of the second part
their heirs executors and administrators, the sum of one
thousand dollars lawful money of these United States
to be paid as much and as nearly quarterly as the money
can well be collected from the funds of Said Charity
School: provided the said parties of the second part shall
provide for and educate each year according to the stipulations
and Terms hereinafter contained, a Sufficient number of
scholars to amount of the said sum of one thou-
sand dollars. [sentence crossed out]
