If one of these persons is a clergyman, tho court w ill so certify, and they will also cer-lily to tlio character and standing of other persons giving such certificates. Tho traditionary evidence of service is deemed very important in the absence of any direct proof, except the declaration ol iho party. And the courts ere requested to be very particular in the inquiry whether Ihe bcliol'is general, and whether any doubts havo ever existed upon ihe subject. To re quire from the applicants positive proof of service from a contemporary survivor, would, alter Iho lapse ot so many years, be to de prive many ot them ot the uenolil ol me law. And as no presumption is raised against the militia by the existence of rolls in the de partment, there is no good reason why this requisition should be extended to them. Un the other hand, to receive the declaration of the parties, as a sullicient ground for placing tliuin upon the pension roll, w ithout corroborating circumstances, would be to open tho Treasury to great frauds. A just medium seems to present ilia best rule lur carrying into ellcct the objects of Congress. The court w ill see that the answers to these questions aro embodied in the decla ration, and they aro requested to annex their opinions of the truth of the sloleiuent of the applicant. iho applicant will further produce in court, if the sain? can be done, in the opinion of court, without too much expoase and inconvenience to him, two rojpoctable persons one of whom should be the nearest clergyman, if one lives in tho immodiate vi cinity of such unpplicant, who can testify, Irom their acquaintance with linn that Ihey believo he is of tlio age he represents, and that h ; is reputed and believed in the neighborhood to havo been a revolutionary soldier, and that they concur in that opinion. If one of these persons is a clergyman, tho court w ill so certify, and they will also cer-lily to tlio character and standing of other persons giving such certificates. Tho traditionary evidence of service is deemed very important in the absence of any direct proof, except the declaration ol iho party. And the courts ere requested to be very particular in the inquiry whether Ihe bcliol'is general, and whether any doubts havo ever existed upon ihe subject. To re quire from the applicants positive proof of service from a contemporary survivor, would, alter Iho lapse ot so many years, be to de prive many ot them ot the uenolil ol me law. And as no presumption is raised against the militia by the existence of rolls in the de partment, there is no good reason why this requisition should be extended to them. Un the other hand, to receive the declaration of the parties, as a sullicient ground for placing tliuin upon the pension roll, w ithout corroborating circumstances, would be to open tho Treasury to great frauds.
