REMARKS OF MIL CUWUING, On the amendments made by (he Setinto to tin- resolutions introduced by Air Bureau, culled tlm "rescinding resolutions." It has been asked, Mr Speaker, by tlm gciitlcnjun from Clermont, (Mr Mcdary) wlinl is iiieiint by the proviso in the nmend-nient lundo by the Semite, coming in us the third rciolution. I om greatly pleased, sir thut the question tins been propounded, und in a brief way, will endeavor to remit to the gentleman a satisfactory response. Upon tliii proviso turns the wholo ipicitiim whether the Legislature, officially, has, the power under our Constitution to instruct our Senators in Congress to do, nr omit to to do, any particular thing, withiu.lha scope of their senatorial function'. Now sir, according to my understanding of the relation in which a Senator in Congress stands to the people of hi St it.-, it ii precisely tho same ill which n Represent!!., tivo stunds to his immedintu constituents. If this proposition be ourrn t, it follows as n corollary, that he cannot he instructed properly, by any agent of tho people, claiming to act officially, unless the people in their primary assemblies have delegated their right of instruction, or unlro such n right is expressly recognized in the Coiis'itutiou to exist with the ugcnt. My belief is that this is the true, sound, and wholesome ill mocru-tio doctrine. Hence it appears to me that this proviso, which is so difficult to be iinih r-stood by gentlemen, snmeiiii most appositely. I will refer gentlemen to tho 8th arii demand 2Sth section of the Couilitu.ion. It is in theso words, and is contained in the declaration of rights. "To guard against the transgreitions of the highpoicen which ue have delegated, we de- CLABS THAT ALL rOWEUB NOT IIK.HKI1V I1ELK' IIUID REMAIN WITH THE I'EOI'liH." If gentlemen can show mu any thing in the Constitution of this State, which even hints at a di legation of the power claimed in the resolutions, which lliosu uniler consideration nre intended to rescind, I ji'ld the question. I am very sale in snyieg this much, for I know, sir, that nothing can be shown in that instruiuont, giving colour to the right claimed. Wc are tcld, sir, that tho right to create and the right to instruct are iiiwp.rnlil Abstract propositions i( this sort mint ho i taken with many grains of allowance. I'Ut : granting the proposition to be true, wills t be contended bv any one, after cool rebec tion, that the Legislature, a majority of; which ore warmed into life by the sunshine of popular favor ill one autumn, and whose political requiem may perhaps be heard in tha gusts nf tho next October; I ask, sir, will it bo insisted that a body of a character so ephemeral ure the crcaturi of Senators in Congress! They nro not. Tho office of Senator is created by the Constitution of the United Stntes. Tho Legislatures of tho several States are merely tho instruments used by tho peoplo in tho choice of this description of their servants; yet it is claimed that theso instruments nre tho legitimate instructors of those, who nro to nil intents und purposes tho offspring nf the pco-nle themselves! Tho power claimed is enormous; and it wns never intonded thnt the Legislature should cxeroise such a power, else wo would Imvo had, at lenst, something of an intimation in tho Constitution, to that cfTcd. I am aware, sir, of this, that the right to instruct by thu Legislature has bce"n ndvocn-ted on the ground that it has been recognized by Senators of other States, and in some Stntes tho right would seem to have become almost prescriptive. It ii very doubtful, though, whether the Constitution nl any one of thoso States, where this custom has obtained, is so clear and explicit as regards th powers to bo exercised legitimately by the Legislature, ns that of Ohio. If it he the fnot, thnt there is no doubt to entertained on this subject, in my poor comprehension, it simply proves, that Senators thus nppoin ted, and thus recognizing the power claimed as unquestionable, have exhibited a lack of nerve, and that true independence, which best befit tho Representatives of a free pen-people. In this State, the results of tho last general election cxposo in bold relief, the fnllncy of the arguments made use of, to defend the resolutions upon which these un der consideration will most probably operate as an extinguisher. Our Senators were in structed, and our Representatives requested, to vote Hgmnst olr Clay's land bill, nml by their votes, to denounco tho Dank of the United States, ana to forth, Mr Ewing, reserved to himself the disorotion to determine whether the instructing resolutions were in nocordnnco with tho will of the people. It is argued that wa have the Tight to instruct our Senators, who hold (heir offices for six years. It is unnecessary lospc ulatc upon the reasons which operated upon the frnmers of the Constitution, to fix the term of service of a Senator, at six years. Few men who have without prejudice or passion, and uninfluenced by purljUm, cx-aiuincd this subject, are willing to believe that a Senator of thu United States is intended us nothing moruthiiuan iiutoniaton. If the Governor were to die, resign or be removed, the Speaker of the Semite, ncting as Governor, may claim tho right of instruction; and in contingency of tho death, removal, resignation, or impeachment of tho Speaker of the Upper Branch, you, sir, if you appoint, linvo as plenary a right to instruct us the Legislature. I om greatly pleased, sir thut the question tins been propounded, und in a brief way, will endeavor to remit to the gentleman a satisfactory response. Upon tliii proviso turns the wholo ipicitiim whether the Legislature, officially, has, the power under our Constitution to instruct our Senators in Congress to do, nr omit to to do, any particular thing, withiu.lha scope of their senatorial function'. Now sir, according to my understanding of the relation in which a Senator in Congress stands to the people of hi St it.-, it ii precisely tho same ill which n Represent!!., tivo stunds to his immedintu constituents. If this proposition be ourrn t, it follows as n corollary, that he cannot he instructed properly, by any agent of tho people, claiming to act officially, unless the people in their primary assemblies have delegated their right of instruction, or unlro such n right is expressly recognized in the Coiis'itutiou to exist with the ugcnt. My belief is that this is the true, sound, and wholesome ill mocru-tio doctrine. Hence it appears to me that this proviso, which is so difficult to be iinih r-stood by gentlemen, snmeiiii most appositely. I will refer gentlemen to tho 8th arii demand 2Sth section of the Couilitu.ion. It is in theso words, and is contained in the declaration of rights. "To guard against the transgreitions of the highpoicen which ue have delegated, we de- CLABS THAT ALL rOWEUB NOT IIK.HKI1V I1ELK' IIUID REMAIN WITH THE I'EOI'liH." If gentlemen can show mu any thing in the Constitution of this State, which even hints at a di legation of the power claimed in the resolutions, which lliosu uniler consideration nre intended to rescind, I ji'ld the question. I am very sale in snyieg this much, for I know, sir, that nothing can be shown in that instruiuont, giving colour to the right claimed. Wc are tcld, sir, that tho right to create and the right to instruct are iiiwp.rnlil Abstract propositions i( this sort mint ho i taken with many grains of allowance. I'Ut : granting the proposition to be true, wills t be contended bv any one, after cool rebec tion, that the Legislature, a majority of; which ore warmed into life by the sunshine of popular favor ill one autumn, and whose political requiem may perhaps be heard in tha gusts nf tho next October; I ask, sir, will it bo insisted that a body of a character so ephemeral ure the crcaturi of Senators in Congress! They nro not. Tho office of Senator is created by the Constitution of the United Stntes. Tho Legislatures of tho several States are merely tho instruments used by tho peoplo in tho choice of this description of their servants; yet it is claimed that theso instruments nre tho legitimate instructors of those, who nro to nil intents und purposes tho offspring nf the pco-nle themselves! Tho power claimed is enormous; and it wns never intonded thnt the Legislature should cxeroise such a power, else wo would Imvo had, at lenst, something of an intimation in tho Constitution, to that cfTcd. I am aware, sir, of this, that the right to instruct by thu Legislature has bce"n ndvocn-ted on the ground that it has been recognized by Senators of other States, and in some Stntes tho right would seem to have become almost prescriptive. It ii very doubtful, though, whether the Constitution nl any one of thoso States, where this custom has obtained, is so clear and explicit as regards th powers to bo exercised legitimately by the Legislature, ns that of Ohio. If it he the fnot, thnt there is no doubt to entertained on this subject, in my poor comprehension, it simply proves, that Senators thus nppoin ted, and thus recognizing the power claimed as unquestionable, have exhibited a lack of nerve, and that true independence, which best befit tho Representatives of a free pen-people. In this State, the results of tho last general election cxposo in bold relief, the fnllncy of the arguments made use of, to defend the resolutions upon which these un der consideration will most probably operate as an extinguisher. Our Senators were in structed, and our Representatives requested, to vote Hgmnst olr Clay's land bill, nml by their votes, to denounco tho Dank of the United States, ana to forth, Mr Ewing, reserved to himself the disorotion to determine whether the instructing resolutions were in nocordnnco with tho will of the people.
